Grandtek Auto Terms of Service

1. Overview

This website is operated by Grandtek Auto. Throughout these Terms of Service, “we”, “us” and “our” refer to Grandtek Auto.

By visiting our website, purchasing a product, booking a service or otherwise dealing with Grandtek Auto, you agree to these Terms of Service, together with the policies and product-specific terms displayed before purchase, where applicable. These include our Returns, Refunds & Warranty Policy and Privacy Policy. A Shipping Policy will also apply once published.

These Terms apply to purchases made online, over the phone and in-store where applicable. Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL).

2. Australian Consumer Law

Our products and services may come with consumer guarantees under the Australian Consumer Law. These rights apply automatically and cannot be removed by store policies, warranty terms or contractual conditions.

Where a product or service fails to meet an applicable consumer guarantee, the remedy available will depend on the circumstances and seriousness of the failure. Any voluntary warranty provided by Grandtek Auto or a manufacturer is additional to, and does not replace, your rights under the ACL.

3. Eligibility to Purchase

By placing an order with Grandtek Auto, you confirm that:

  • the information you provide is accurate and complete;
  • you are authorised to use the payment method provided;
  • you are legally capable of entering into the transaction; and
  • where relevant, you have provided accurate vehicle information for products requiring vehicle-specific fitment.

We reserve the right to decline or cancel an order where permitted by law, including where fraud, unauthorised payment, incorrect pricing or stock availability issues are identified.

4. Products

We make reasonable efforts to ensure product descriptions, photographs, specifications and fitment information are accurate. However, product colours may appear differently depending on your screen; packaging, products or specifications may change; minor appearance differences may occur; and vehicle models may vary by year, trim, body type, accessories or previous modifications.

Customers should carefully review product details before purchasing. If you are unsure whether a product is suitable for your vehicle, please contact Grandtek Auto before placing your order.

5. Vehicle Information and Fitment

Where a product is vehicle-specific, the customer is responsible for providing correct vehicle information. This may include make, model, year, series, body type, variant, engine, existing modifications or other information reasonably required to determine compatibility.

If incorrect vehicle information is supplied by the customer and the wrong item is ordered, any return may be assessed under our change-of-mind or incorrectly ordered return policy. Under that policy, return freight is generally the customer’s responsibility and a 10% restocking fee applies to approved change-of-mind or incorrectly ordered returns. These conditions do not limit ACL rights.

6. Fitment Disputes

If you advise us that a product does not fit your vehicle, we may request reasonable information to investigate, including photographs, measurements, vehicle details, installation information or details of vehicle modifications.

Where reasonable and practical, Grandtek Auto may offer to inspect the vehicle and product or perform a test fit at our Prestons workshop. If attending is impractical, we will discuss other reasonable ways to assess the issue.

An unsuccessful installation attempt by a customer or third-party installer does not automatically establish that the product is unsuitable. Equally, the fact that a product can be fitted does not, by itself, resolve a claim that it was incorrectly described, incorrectly supplied or failed to meet an ACL consumer guarantee.

If Grandtek Auto confirms that the product is suitable for the nominated vehicle and meets applicable consumer guarantees, but the customer no longer wishes to keep it, any return may be treated as a change-of-mind return. In that situation, a 10% restocking fee may apply, return freight remains the customer’s responsibility, and original delivery charges are generally not refundable.

If the product was incorrectly supplied, incorrectly described or otherwise fails to meet an ACL consumer guarantee, it will be dealt with in accordance with the law and our Returns, Refunds & Warranty Policy.

7. Pricing

All prices displayed on our website are in Australian dollars unless otherwise stated. We may change prices at any time before an order is placed. Prices may vary between online and in-store offers, promotional periods, clearance products and special orders.

If an obvious pricing error occurs, we may contact you before processing the order. Where payment has already been taken and an order cannot lawfully or reasonably be fulfilled at the displayed price, we will discuss the available options with you, including a refund where appropriate.

8. Payment

Orders must generally be paid in full before goods are dispatched unless another arrangement has been agreed. Available payment methods may change from time to time.

Where a third-party payment provider is used, such as a card processor or buy-now-pay-later provider, the provider may also have separate terms that apply to your transaction. Grandtek Auto is not responsible for delays caused by a customer’s bank or payment provider.

9. Order Acceptance

Submitting an order does not necessarily mean that Grandtek Auto has accepted the order. We may need to verify payment, stock, product availability, pricing, shipping availability, vehicle compatibility or other order information. We may contact you if further information is required.

10. Order Changes and Cancellations

If you need to change or cancel an order, contact us as soon as possible. We cannot guarantee that an order can be changed or cancelled after it has been dispatched, ordered from a supplier, entered production, customised, specially imported or otherwise committed specifically for your order.

Special-order, custom-made and imported products may not be eligible for change-of-mind cancellation once supplier confirmation or production has commenced. This does not affect rights available under the ACL.

11. Shipping and Delivery

Shipping times displayed on our website or communicated to customers are estimates unless expressly stated otherwise. Delivery may be affected by matters outside Grandtek Auto’s reasonable control, including courier delays, weather, supplier delays, public holidays, remote delivery locations, transport interruptions or incorrect delivery information supplied by the customer.

Customers are responsible for providing accurate delivery details. Please inspect deliveries as soon as reasonably possible after receipt. If an item appears damaged in transit, contact Grandtek Auto promptly—ideally within 7 days—and retain the packaging while we investigate. Reporting later does not automatically invalidate an ACL claim; each claim will be assessed on its evidence and legal rights.

12. Risk and Ownership

To the extent permitted by law, responsibility for goods generally passes to the customer once the goods have been delivered to the nominated delivery address or collected by the customer. Ownership of goods does not pass until payment has been received in full.

Nothing in this section limits any rights relating to goods that arrive damaged, are not delivered, are incorrectly supplied or otherwise fail to meet an applicable consumer guarantee.

13. Returns

Grandtek Auto provides a voluntary 30-day change-of-mind return policy, subject to the conditions in our Returns, Refunds & Warranty Policy. Change-of-mind items must generally be unused, uninstalled, undamaged, unmodified, suitable for resale and returned with original components and accessories. These conditions do not limit claims made under the ACL.

Customers should contact Grandtek Auto before returning an item. Returns sent or brought back without first being discussed with our team may take longer to identify, assess and finalise. Prior approval is not a condition of exercising ACL rights.

14. Change-of-Mind Returns

For an approved change-of-mind or incorrectly ordered return:

  • the customer pays return freight, or may return the item to our Prestons store;
  • a 10% restocking fee is deducted from the returned item’s purchase price; and
  • original delivery charges are not refunded.

These charges do not apply where Grandtek Auto supplied an incorrect item or where an ACL remedy applies.

15. Installation

Some automotive products require specialist knowledge and installation. Customers should ensure products are installed correctly and, where appropriate, by a suitably qualified and experienced installer.

Grandtek Auto is not responsible for damage caused by incorrect installation, wiring, forced fitment, inappropriate tools or hardware, incorrect removal or reinstallation, or third-party modification.

Where installation or modification caused the particular damage being claimed, that damage may not be covered by a voluntary warranty. However, third-party installation does not automatically remove consumer rights relating to an unrelated product defect.

16. Products Installed by Grandtek Auto

If Grandtek Auto installs a product and you experience a problem, please contact us before arranging third-party repair, removal or modification where reasonably possible. We may request an opportunity to inspect the vehicle, product or installation.

Work performed elsewhere before inspection may make determining the cause more difficult, but it does not automatically remove rights available under the ACL.

17. Installation and Labour Charges

Unless otherwise stated, installation charges are separate from the product price. Grandtek Auto does not generally reimburse third-party installation, removal, reinstallation, labour or diagnostic charges where the relevant problem was caused by third-party installation, misuse, modification or damage.

Where the ACL provides an entitlement to compensation for reasonably foreseeable loss or damage, the claim will be assessed in accordance with the law.

18. Faulty Products

If you believe a product is faulty, please contact Grandtek Auto. We may reasonably request photographs, videos, diagnostic or installation information, or an opportunity to inspect the product.

If continued use could cause further damage or create a safety risk, please stop using the product until it has been assessed. Where a product fails to meet an applicable consumer guarantee, the available remedy will be determined in accordance with the ACL.

19. Warranties

Any manufacturer’s warranty or voluntary warranty offered by Grandtek Auto is additional to your ACL rights. Warranty coverage may contain reasonable conditions, but those conditions cannot remove rights that exist independently under the ACL.

Where damage has been caused by incorrect installation, modification or misuse, that damage may fall outside a voluntary warranty. A separate or unrelated manufacturing defect will still be assessed on its own circumstances.

20. Special Orders and Custom Products

Custom-made, specially ordered, imported or customised goods may not be eligible for change-of-mind return or cancellation. Where a product has been specifically ordered or manufactured for you, cancellation may no longer be available after supplier confirmation, commencement of production, import arrangements or customisation has begun.

This does not affect remedies required under the ACL.

21. Clearance and Sale Items

Products sold as clearance, run-out or discontinued may be excluded from our voluntary change-of-mind policy where this was clearly disclosed before purchase. However, sale or clearance status does not remove any applicable consumer-guarantee rights.

22. Product Modification

Customers should not cut, drill, trim, paint, weld, grind, rewire, alter or otherwise modify a product unless the modification is appropriate for the product and installation.

Modified products generally cannot be returned under our voluntary change-of-mind policy. Where modification causes damage, that damage may not be covered under a voluntary warranty. This does not limit ACL rights for an unrelated defect.

23. Website Information

We aim to keep our website accurate and up to date. However, it may occasionally contain typographical errors, outdated information, pricing errors, product description errors, stock inaccuracies or technical errors. We may correct website information when errors are discovered.

Nothing in this section allows Grandtek Auto to make false or misleading representations about products or customer rights.

24. Product Images

Product photographs are provided for general reference. Actual products may vary slightly due to manufacturing changes, product revisions, lighting, screen settings, vehicle configuration or model variations.

Where appearance, specification or fitment is important to your purchase, please contact us before ordering. Nothing here limits rights where goods do not match their description or representations made before purchase.

25. Intellectual Property

Unless otherwise stated, material appearing on the Grandtek Auto website—including logos, branding, graphics, photographs, website content, product descriptions and written material—is owned by or licensed to Grandtek Auto.

You must not reproduce, distribute, republish or commercially use our material without permission, except where permitted by law.

26. Third-Party Links

Our website may contain links to third-party websites or services. Grandtek Auto does not control third-party websites and is not responsible for their content, availability or separate terms and policies. Customers should review the terms and privacy practices of third-party services before using them.

27. Prohibited Use

You must not use our website for unlawful purposes; to attempt fraud or unauthorised transactions; to interfere with its operation; to distribute malicious software; to obtain unauthorised access to systems or accounts; to copy or scrape protected website material unlawfully; or in any manner that infringes another person’s rights.

28. Liability

To the maximum extent permitted by law, Grandtek Auto is not responsible for losses caused by matters outside our reasonable control or by misuse of a product, incorrect installation, unauthorised modification, use contrary to instructions, customer-supplied incorrect information or damage caused by third parties.

Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded under the ACL or other applicable law. Any limitation will be applied only to the extent permitted by law and reasonably necessary in the circumstances.

29. Privacy

Personal information collected by Grandtek Auto will be handled in accordance with our Privacy Policy and applicable privacy requirements. Information may be used where reasonably necessary to process orders, arrange deliveries, communicate with customers, investigate warranty or return claims, prevent fraud and operate our business.

30. Changes to These Terms

Grandtek Auto may update these Terms of Service from time to time. The version applying to a transaction will generally be the version in effect when that transaction was entered into, subject to applicable law. Changes will be published on our website.

31. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision may be read down or severed to the extent necessary, while the remaining provisions continue to operate where legally possible.

32. Governing Law

These Terms are governed by the laws applicable in New South Wales, Australia, together with applicable Commonwealth laws. Nothing in this clause prevents a consumer from exercising rights available under applicable consumer law.
